New EPA Diesel Fuel Additive Regulation

ATTENTION

Please take time to read the information following (Memo Regarding Recent EPA Diesel Fuel Additive Regulation).  The products that Prime Automotive Warehouse includes in its catalog that fall under the new regulation are listed below.  As you will see, those products fall into two categories - ‘compliant’ and ‘non-compliant’.  We have initiated the labeling of those items that were shipped to us from our suppliers without a label; however, there remains the possibility that you have some of these items on your shelves that need relabeling.  If you need some labels, we will send them to you upon request.  Please contact your salesperson and let them know the quantity of each type label you need.  The labels include the exact wording that the EPA regulation requires.  NOTE there are 2 different labels – please take every measure to make sure the ‘compliant’ products are labeled with a ‘compliant’ label and the ‘non-compliant’ products are labeled with a ‘non-compliant’ label.  Also, please attach the appropriate label to each individual product in an area that is noticeable but does not cover up any of the other labeling on the product.

Memo Regarding Recent EPA Diesel Fuel Additive Regulation

 

OVERVIEW OF THE SITUATION

 

The diesel fuel additive industry has been aggressively working to address new labeling requirements for consumer diesel fuel additives that have been adopted by the U.S.A. Environmental Protection Agency (the EPA).

 

A new EPA regulation for diesel fuel additives went into effect on June 1, 2006 while the vast majority of the consumer diesel fuel additive industry was not notified or made aware of this requirement before May 1, 2006.  Therefore, products remaining on store shelves or in retail inventory prior to June 1, 2006 may not be appropriately labeled.

 

This regulation requires that all diesel fuel additives SOLD after June 1, 2006 be labeled with one of two statements on the container depending on the sulfur content of the product:

 

1)      For those additives sold in containers for use by the ultimate consumer with a sulfur content not exceeding 15 ppm, the following statement applies:

“This diesel fuel additive complies with the federal low sulfur content requirements for use in diesel motor vehicles and nonroad engines.”

 

2)      For those additives sold in containers for use by the ultimate consumer, with a sulfur content in excess of 15 ppm, the following statement applies:

“This diesel fuel additive does not comply with federal ultra-low sulfur content requirements for use in model year 2007 and newer diesel motor vehicles or model year 2011 and newer diesel nonroad equipment engines.”

 

AFFECT ON OUR CUSTOMERS

 

All retail outlets, distributors, and distribution centers need to attach sticker labels to product currently in the stream of commerce.

 

At Prime Automotive Warehouse, we have been and are currently labeling our affected products in our warehouse.  However, any product you may have ordered before June 1, 2006 may require a sticker with one of the statements mentioned above.

 

LIST OF PRODUCTS AND WHICH LABEL IS REQUIRED FOR EACH PRODUCT

 

Prime has developed a list of products we sell that have been affected by the new regulation.  In addition, we have noted which label is required for each product.  This combined list is attached.

 

HOW TO GET LABELS FOR YOUR PRODUCT

 

You can obtain labels by contacting our sales department directly by phone at 800.231.4051.  Please let your sales person know how many of which type of labels you need and they will be mailed to you.  Let your sales person know where to mail the labels and to who’s attention, product number(s) and quantity of labels needed.

 

HOW AND WHERE TO AFFIX THE LABELS

 

Please attach the appropriate label to each individual product, in an area that is noticeable but does not cover up any of the other labeling on the product.
